Terms of Service — Dvg Social

1. Parties and Scope

These Terms of Service govern the legal relationship between Dvg Social ("Platform") and any individual or legal entity that accesses or uses the Platform ("User"). By registering for or accessing the Platform in any way, you are deemed to accept these Terms.

2. Description of Service

Dvg Social is a SaaS (Software-as-a-Service) platform that helps brands generate, schedule, and publish social media content to Instagram with AI assistance. The Platform covers text generation, image/video creation, a post calendar, and automated publishing.

3. Account Creation and Security

A valid email address is required to register for the Platform.
You are responsible for the confidentiality and security of your account credentials.
You must report any unauthorized access to your account immediately.
Creating multiple accounts for the same person is prohibited.

4. Acceptable Use

By using the Platform, you agree to:

Comply with all applicable local, national, and international laws
Only generate content for brands, products, and accounts you own or are authorized to represent
Comply with Meta's (Instagram) Platform Policies and Developer Terms
Not produce spam, misleading, infringing, or harmful content
Not attempt to damage or interfere with Platform systems

5. Meta Platform Integration

The Platform uses the Instagram Graph API (via Instagram Business Login) to publish content to your connected Instagram Business account and to display account statistics. By connecting your Instagram account, you also accept Meta's Platform Terms and Developer Policies. The Platform only requests the permissions you explicitly consent to (basic profile access and content publishing). The Platform is not liable for service interruptions caused by changes to Meta's API usage limits or policy updates.

6. Intellectual Property

Intellectual property rights to content generated through the Platform belong to the User. The Platform will not use generated content in its own advertising or marketing materials without the User's permission.

The Platform's software, interface, logo, and brand elements belong to Dvg Social. Unauthorized copying, distribution, or commercial use of these elements is prohibited.

7. Service Continuity and Disclaimer of Warranty

While the Platform aims to provide uninterrupted, error-free service, temporary interruptions may occur due to technical maintenance, infrastructure failures, or third-party API outages. The Platform makes no express or implied warranty regarding service availability.

8. Limitation of Liability

The Platform is not liable for direct or indirect damages arising from content the User generates, AI-generated output, social media account access errors, or policy changes by third-party platforms. Users are encouraged to review AI-generated content before publishing it; the User bears full responsibility for all content published through the Platform.

9. Account Suspension and Termination

In case of a breach of these Terms, the Platform reserves the right to temporarily suspend or permanently close an account without prior notice. Users may delete their account at any time; upon deletion, data is removed from our systems within 30 days.

10. Changes

The Platform reserves the right to update these Terms at any time. Material changes will be communicated to your registered email address. Continuing to access the Platform after a change constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Any disputes between the parties are subject to the exclusive jurisdiction of the Istanbul courts and enforcement offices.
